Bismarck, N.D.  —When approaching an intersection with non-operating traffic lights, first look for an official who may be directing traffic. If an official is present, follow their commands. If an officer is not present, drivers should use extreme caution and not assume they have the right of way.  North Dakota State law specifies that in these situations, drivers shall regard an intersection with non-operating traffic lights the same as an intersection with four way stop signs.

If all traffic signal lights are flashing red at the intersection this means the same thing as a stop sign—STOP. Proceed when the intersection is clear of pedestrians and vehicles. Flashing yellow at an intersection means proceed with caution.

We ask motorists to use common sense and approach an intersection with non-operating traffic lights with extreme caution until temporary signs are placed or the signal light is repaired,” said Paul Fraase, City Attorney.  Keith Hunke, Assistant City Administrator, asks citizens to “please drive defensively”. “Don’t assume that cross traffic is going to stop.  Public safety is our primary concern,” said Hunke.
